Last updated: 1 January 2025. These Terms apply to both the EMoto website and the EMoto Charge App. This is a general framework document — your specific Work & Pay hire-purchase agreement, if any, is a separate signed contract and takes precedence over anything here where the two conflict.

Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the EMoto website (emotoghana.com), the EMoto Charge App, and any products or services offered by EMoto LTD ("EMoto", "we", "us", "our"). By visiting our website, creating an account, downloading the App, or placing an order, you agree to be bound by these Terms.
If you do not agree to these Terms, please do not use our website, App, or services.

Who We Are
EMoto LTD assembles, sells, services, and finances electric 2-wheelers and 3-wheelers, and operates DC fast charging and battery swapping infrastructure across Ghana.

Eligibility
To use our services, you must:
- Be at least 18 years old
- Hold a valid Ghana Card or Voter ID for identity verification
- Hold a valid driver's licence authorising you to ride a motorcycle in Ghana, if you intend to ride an EMoto vehicle on public roads
- Provide accurate and complete information when creating an account, placing an order, or applying for Work & Pay financing
Applicants for Work & Pay (hire-purchase) financing must also provide guarantor and next-of-kin details as part of the onboarding process, as described in our Privacy Policy.

Products & Services
EMoto offers:
- Electric vehicles — 2-wheelers and 3-wheelers sold outright or through Work & Pay financing
- Charging infrastructure — DC fast charging, battery swap cabinets, and home charging equipment included with every vehicle
- The EMoto Charge App — for tracking battery/range, finding charging or swap points, managing payments, and monitoring Work & Pay schedules
- Repair, maintenance, training, and fleet services for individual riders and business fleets
- Gear & accessories — helmets, riding gloves, rain coats, and chargers
Vehicle availability, specifications, and pricing may change without notice and can vary between our website, showroom, and third-party listings. The showroom or your sales representative will confirm final specifications and pricing before you complete an order.

Orders, Pricing & Payment
Orders placed through our website are requests to purchase or finance a vehicle, not a guaranteed sale — our team will confirm your order, typically within one business day, before it is finalised.
- Prices are listed in Ghana Cedis (GHS) and may be subject to change until an order is confirmed
- In-app wallet top-ups and charging session payments are processed by Kowri, our Mobile Money payment partner, over encrypted connections
- EMoto does not store your full Mobile Money PIN or card details
- You are responsible for ensuring you have sufficient funds or wallet balance before starting a paid charging session

Work & Pay (Hire-Purchase) Agreements
Work & Pay lets you ride an EMoto vehicle with a low deposit and pay the balance weekly from what the vehicle earns you. Where you choose Work & Pay financing:
- You pay an initial deposit — as little as 20% depending on the vehicle and agreement — and ride out the same day
- Weekly payments are tracked in the EMoto Charge App against your specific hire-purchase agreement
- Ownership of the vehicle transfers to you once the full financed amount has been paid, in accordance with your signed hire-purchase agreement
- You may pay off the remaining balance early and take outright ownership at any time
- Missed or late payments, and any resulting fees, penalties, or actions (including suspension or repossession), are governed by the specific terms of your individual hire-purchase agreement, which you will review and sign separately before financing begins
Nothing in these general Terms overrides the specific terms of your signed Work & Pay agreement — where the two differ, your signed agreement controls.

Vehicle Registration & Compliance
Every EMoto model meets DVLA road-legal standards.
You are responsible for keeping your own driving licence and any other legally required documentation valid and up to date while operating an EMoto vehicle on public roads.

Warranty
Every EMoto battery is backed by a five-year warranty and a local replacement guarantee. Our mobile technician teams aim to reach you within two hours anywhere in Greater Accra for service requests.
The warranty covers manufacturing defects under normal use and does not cover damage from accidents, misuse, unauthorised modification, or normal wear and tear. Full warranty terms are provided at the point of sale or financing and may vary by vehicle model.

Mobile App — Acceptable Use
When using the EMoto Charge App, you agree not to:
- Share your account credentials or allow another person to use your account to access charging sessions or Work & Pay financing intended for you
- Attempt to tamper with, bypass, or interfere with charging piles, swap cabinets, or their QR-code authentication
- Use the App or its payment features for any fraudulent or unlawful purpose
- Attempt to reverse-engineer, decompile, or interfere with the App's underlying software or infrastructure
We may suspend or terminate App access for accounts found in breach of this section.

Intellectual Property
The EMoto name, logo, website, App, and all associated content, designs, and software are the property of EMoto LTD or its licensors and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without our prior written consent, except as necessary to use our website and App for their intended purpose.

Limitation of Liability
Our website, App, and services are provided on an "as available" basis. To the fullest extent permitted by Ghanaian law, EMoto is not liable for indirect, incidental, or consequential losses arising from your use of our website, App, vehicles, or charging network, except where such liability cannot be excluded by law (including in cases of death, personal injury, or fraud caused by our negligence).
Nothing in these Terms limits any statutory rights you have as a consumer under Ghanaian law.

Termination
You may stop using our website and App at any time. We may suspend or terminate your access to the App or your account if you breach these Terms, provide false information, or engage in fraudulent or unlawful activity. Termination of App access does not, on its own, affect the terms of a separately signed Work & Pay hire-purchase agreement, which is governed by its own conditions.

Governing Law & Changes to These Terms
These Terms are governed by the laws of the Republic of Ghana. Any disputes arising from these Terms or your use of our services will be subject to the exclusive jurisdiction of the courts of Ghana, without prejudice to any right you may have to raise a complaint with a relevant regulatory authority.
We may update these Terms from time to time to reflect changes in our services or legal requirements. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify registered users in-app. Continued use of our website or App after changes take effect constitutes acceptance of the revised Terms.
